I think policing and enforcement problems should often cause us to give way to individual conscience on lots of proposals by either side of the "culture war". Attack the issue with education and persuasion concerning the merits. (Not talking formal education here.)

     We are criminalizing society.  If I break the law every day, how likely is it that law will be important to me.  I refer to Aristotle: There should be few laws but they should be well enforced.  If you can't enforce a law, don't pass it.  I have no problem with education about smoking and sugar and wealth (how to make more).
