"A subpoena or a pizza."



It's official.  The 2nd Amendment, like the first, third, fourth, fifth, sixth, seventh, eighth and ninth, is an individual right against encroachment by the government.  As I asked in a previous post, why is the 2nd Amendment supposed to be so different?  When Madison introduced the Amendments as a protection for the people there was no discussion of the questions that government gets to ask in order to assure those rights.  They are clear.  No penumbras required here.

But today, as one writer noted, "I'm not sure if I can order a ham sandwich without Kennedy's up or down." 

There have been some good articles on the Heller ruling but the best summary I've heard was given by a citizen of Maryland who adeptly explained the power of the individual right and its relationship to property rights in this country: "My domicile is my domicile.  If you want to come in to my domicile, you better have a subpoena or a pizza."
