It is called humor.  Sometimes it is bawdy.  Sometimes it misses.  Sometimes it is funny.  It doesn't mean that when you have pure filth involved in a case, you can't recognize it.  Was some of the humor tasteless?  Absolutely.  Does it mean that Judge Kozinski can't sit over a case of related to porn?  I don't think so.
